WHAT IS IT?


In the context of the Living Environment Activities Decree, the Dutch government introduced in July 1, 2023 an obligation to provide an energy savings research report every 4 years for companies that consume more than 10 million KWh of electricity or 170,000 m3 of natural gas (equivalent).


This research obligation also applies to the greenhouse horticulture activity.

The investigation obligation must be submitted before December 1, 2023 and must include measures to be implemented with a payback period of 5 years.


In most cases the local Municipality will be responsible for enforcing this law.


The Energy Saving Research Obligation is, in addition to the European reporting obligation under the Energy Efficiency Directive (EED) and the information obligation, a reporting obligation and concerns measures that reduce a company's CO2 emissions. The obligation to investigate applies to companies with high energy consumption that carry out certain environmentally harmful activities.


The obligation to investigate only applies to activity-related measures and therefore not to building-related measures, such as insulation of the building.



WHAT ARE THE REQUIREMENTS ?


The report for the energy saving research obligation must contain, amongst other things:


> Description and analysis of the site, installations, processes and energy use

> Mapping of the CO2 reducing measures with a payback of 5 years 

> Analysis of the electrical systems to reduce electricity and energy consumption

> Inventory of all electrical installations and pipes that can be insulated for energy savings


From January 1, 2024, the energy saving obligation will be included in the new Environmental Act.
