In everyday language there is common confusion between kW and kWh .

This article is to help clarify the difference in the commercial world.

Difference between kW (Power) and kWh (Consumption/Production):

The kW is a multiple of the watt (1 kW = 10^3 W), a unit of power particularly used in the electrical industry.

The power of a machine measures its capacity to deliver or consume a quantity of energy per unit of time.

The kWh , multiple of the watt-hour (1 kWh = 10^3 Wh), is used to quantify the energy delivered .

1 kWh corresponds to the energy consumed by a device with a power of 1 kW for a period of one hour (1 kW × 1 h).

We therefore do not consume kW but kWh.

Further ESOS Phase 3 updates

ESOS Legislation is changing .

The UK Energy Savings Opportunity Scheme (ESOS) is presently in Phase 3.

The deadline for compliance is set for 5th June 2024, yet the Environment Agency is holding off on enforcement actions for non-compliance.

Businesses and institutions are granted until 6th August 2024 to register their compliance, provided they have registered on the compliance portal by 5th June 2024.

Main changes this year :

Businesses adhering to ESOS regulations are required to register their account on the new IT system before 5th June 2024 and submit their compliance notification by 6th August 2024 .

Businesses will be required to account for a minimum of 95% of their total energy consumption. This is referred to as the 'de minimis' rule, previously set at a minimum of 90%.

Businesses will be required to provide additional detail on how they calculate their energy consumption , which includes energy intensity ratios. An energy intensity ratio measures the energy consumption using a relevant metric (for instance, energy use as kWh per m2 for buildings, kWh per unit output for industry, and kWh per mile for transport).

Explain how energy audit site visits represent overall energy usage , especially if not all sites are audited.

Share ESOS Report Details: Distribute ESOS report information to all members of the corporate group.

Provide more detailed information on energy-saving opportunities, covering costs, benefits, and implementation plans.

Organisations must submit an annual ESOS Energy Action Plan post-ESOS submission, offering yearly progress reports on energy-saving endeavours and commitments. To know more click here .

The Environment Agency will record and publicly publish the Energy Action Plan . Non-compliance or lack of energy-saving efforts will also be publicly disclosed , potentially impacting reputation, competitiveness, and incurring penalties.

Changes in ESOS affect organisations with ISO 50001 certification , which were previously exempt from reporting. They must now provide detailed reports on energy savings achieved since the previous compliance period.

Despite the Phase 3 deadline extension, Phase 4 of ESOS remains scheduled for 5th December 2027, with compliance spanning from 6th December 2023 to 5th December 2027. Phase 4 will emphasise energy efficiency and require plans towards achieving net-zero status.

Penalties for Non-Compliance :

Failure to Notify : Initial penalty of up to £5,000.

Daily penalty of up to £500 for each working day in breach, regardless of audit completion.

Failure to Maintain Records: Initial penalty of up to £5,000.

Additional costs for confirming compliance, borne by the organization.

Remedial actions required.

Failure to Undertake Energy Audit: Initial penalty of up to £50,000.

Daily penalty of up to £500 for each working day in breach.

Remedial actions required.

New entrants face a lower initial penalty of up to £5,000.

Failure to Comply with Enforcement/Penalty Notice: Initial penalty of up to £5,000.

Daily penalty of up to £500 for each working day in breach.

False or Misleading Statement: Penalty of up to £50,000.

If your company has 100 or more employees in the Netherlands, you are obliged to report on the business traffic and commuting of your employees from 1 July 2024 .

OVERVIEW.

Employers must now track and report employees' CO2 emissions .

It applies to organizations with 100 or more employees from July 1, 2024.

The law is Rapportageverplichting werkgebonden personenmobiliteit .

The first report is due on July 1, 2025.

WHY?

This regulation aims to understand work-related passenger mobility emissions (20% of total CO2).

It is part of the Dutch government efforts to reduce CO2 emissions by 49% by 2030.

Around 8,000 companies are being affected and it includes all salaried employees with a contract of at least 20 hours per month.

WHAT ARE THE REQUIREMENTS?

Reports must include:

Annual reporting of commuter and business kilometers.
Total mileage, travel modes, and fuel type.
It includes travel within The Netherlands, it excludes international travel.

WHAT COMPANIES CAN DO TO REDUCE CO2 EMISSIONS FROM MOBILITY?

Electrify fleets, limit lease cars, reduce parking spaces, encourage biking, and promote remote work.
Offer incentives for sustainable travel and provide reimbursements for public transport and bicycle kilometers.

ENFORCEMENTS.

The environmental agency will monitor this regulation.

The agency will control and verify if your organization has submitted the report and it will assess the quality of your data.

Ad-hoc fines are expected for non-compliance.

An EAC can be sold either together with the underlying energy contract or separately. When the EAC and underlying electricity are traded in a contract together, it is described as ‘bundled’. In either case, the principles remain unchanged and there are two separate product streams: 1. the electricity, and 2. the underlying attributes, as represented by an EAC. Both bundled as well as unbundled use of EACs are valid means of renewable energy consumption.

An EAC may be sold individually or with the underlying energy contract. A contract is said to be "bundled" if the EAC is included. 'Unbundled' refers to the purchasing of both electricity and EAC independently. Either way, the fundamental ideas are the same with two distinct products: the

electricity and the underlying EAC.

Every system is equipped with its unique set of regulations and a registry structure. The primary geographical markets encompass four main regions:

- Guarantees of Origin (Go) : The European Union Renewable Energy Directive (REDII) mandates that both electricity suppliers and consumers employ Guarantees of Origin to record and disclose claims related to renewable electricity in Europe.

- National systems : Nations like the UK, Poland, Australia, Japan, and New Zealand have established their own national Energy Attribute Certificate (EAC) systems. In certain instances, these national certificates can be utilised to record and validate consumption that transcends international borders.

- Renewable Energy Certificates (RECs) : These are used in the United States and Canada. In the US, Renewable Energy Certificates (RECs) serve dual purposes, being employed for both regulatory compliance reporting and voluntary consumption.

- International Renewable Energy Certificates (iRECs) : I-REC represents a more recent global standard implemented in regions lacking an existing market mechanism, drawing inspiration from the successful practices of North American and European systems. WHAT IS IT?

In the context of the Living Environment Activities Decree , the Dutch government introduced in July 1, 2023 an obligation to provide an energy savings research report every 4 years for companies that consume more than 10 million KWh of electricity or 170,000 m3 of natural gas (equivalent).

This research obligation also applies to the greenhouse horticulture activity.

The investigation obligation must be submitted before December 1, 2023 and must include measures to be implemented with a payback period of 5 years.

In most cases the local Municipality will be responsible for enforcing this law.

The Energy Saving Research Obligation is, in addition to the European reporting obligation under the Energy Efficiency Directive (EED) and the information obligation , a reporting obligation and concerns measures that reduce a company's CO2 emissions. The obligation to investigate applies to companies with high energy consumption that carry out certain environmentally harmful activities.

The obligation to investigate only applies to activity-related measures and therefore not to building-related measures, such as insulation of the building.

WHAT ARE THE REQUIREMENTS ?

The report for the energy saving research obligation must contain, amongst other things:

> Description and analysis of the site, installations, processes and energy use

> Mapping of the CO2 reducing measures with a payback of 5 years

> Analysis of the electrical systems to reduce electricity and energy consumption

> Inventory of all electrical installations and pipes that can be insulated for energy savings

From January 1, 2024, the energy saving obligation will be included in the new Environmental Act .

In recent times, the focus of global energy policies and discussions has been on the imperative of decarbonising the energy sector during the transition towards achieving net-zero emissions.

Nevertheless, despite efforts to reduce carbon emissions, more than 80% of the world's primary energy usage still stems from fossil fuels .

Among these, coal, renowned for being the most cost-effective energy source globally, stands out as the largest contributor to CO2 emissions associated with energy production.

In 2022, the worldwide usage of coal exceeded 8 billion tonnes in a single year for the first time, with China and India emerging as the two biggest consumers.

China's power industry contributes to a third of the planet's coal usage.

Simultaneously, India, with an annual growth rate of 6%, has doubled its coal consumption since 2007—prospects indicate that it is expected a surge in coal consumption for the following years.

Demand for coal in developed nations

The use of coal in the United States has experienced an approximate 50% decrease in contrast to the early 2010s.

Efforts such as the Inflation Reduction Act (IRA), which allocates nearly $370 billion to expedite the energy transition in the U.S., are anticipated to uphold the decline in coal consumption trajectory within the United States.

A similar trend can be observed within the European Union.

For instance, in France, only 2.5% of its primary energy consumption is sourced from coal, a proportion that is merely half of what it was in the early 2000s.

In Germany, which boasts Europe's largest economy, coal still contributes to 18.9% of the total energy consumption (slightly up from 2021 due to the energy crisis). Nevertheless, a decade ago in 2012, that figure was even higher, constituting 24.9% of primary energy utilisation.

While coal consumption is decreasing in developed nations but maintaining stability in emerging economies, the International Energy Agency predicts that the demand for coal will level off at the levels seen in 2022 until 2025, at which point it will commence declining.

ESOS Phase 3 updates

The Department of Energy Security and Net Zero (DESNZ) extended the Phase 3 compliance deadline to 5 June 2024 to give companies time to meet the new reporting requirements, which are aimed at improving the scheme and taking greater action on energy efficiency.

In this article we summarise the changes.

WHAT'S NEW:

Requirement for a summary template to include compliance information in the ESOS report
Requirement to submit additional data in the compliance notification (it can be found in Annex A from DESNZ)
Requirement to include an energy intensity metric in ESOS reports
A change to the de minimis exemption so that participants’ Significant Energy Consumption covers at least 95% of their Total Energy Consumption (as compared to 90% in Phase 2)
Requirement for ESOS reports to provide more information on next steps for implementing recommendations
Requirement for participants to set a target or action plan following the Phase 3 compliance deadline, on which they will be required to report against annually
Requirement to share ESOS reports with subsidiaries

The changes will be subject to legislative scrutiny and timetable, with the enabling primary legislation (The Energy Bill) currently passing through Parliament. Government will update participants when the Energy Bill has received Royal Assent, and the draft regulations are introduced to ensure there is a reasonable amount of time to meet the new requirements.

From Jules Vernes to Jérémy Rifkin, there have been many visionaries anticipating the advent of a hydrogen society.

Long considered a mirage, hydrogen is making a strong comeback in the energy debate and the European Union recently published its hydrogen strategy.

Could we be at the start of a major revolution thanks to this gas discovered in 1766 by the chemist Cavendish, then baptised “hydrogen” by Lavoisier?

Hydrogen could help accelerate the energy transition towards renewable sources - provided that it is free from fossil fuels.

Hydrogen yesterday and today: a by-product of fossil fuels

Representing 75% of the gaseous mass of the sun, hydrogen is considered the most abundant element in the universe. On Earth, it is not very present in its pure state: very light, it is in fact not retained by gravity.

However, hydrogen is available all around us combined with other elements. It is found in each molecule of water. Associated with carbon, it is in all plants and animals. Fossil fuels, themselves derived from the decomposition of living matter, are no exception. Hydrogen can be produced by separating it from these other elements.

According to the International Energy Agency (IEA), approximately 70 Mt of pure hydrogen is produced each year. The vast majority of this hydrogen comes from the processing of natural gas (69%) and coal (27%). Water electrolysis and other routes provide the rest.

Since 1975, global hydrogen production has quadrupled . The two main markets were oil refining – where hydrogen is used to desulphurize and purify fuels – and the production of ammonia, itself mainly intended for the manufacture of fertilizers.

Global annual demand for hydrogen since 1975

This rapid development of hydrogen has unfortunately in no way contributed to the decarbonisation of economies. In 2018, global hydrogen production caused the release of 830 Mt of CO2 into the atmosphere according to the IEA, i.e. the equivalent of 2.5 times of France's CO2 emissions.

Differences: “gray” hydrogen, “blue” hydrogen or “green” hydrogen?

"Gray Hydrogen is obtained directly from natural gas or coal. It emits around 9 kg of CO2 from gas and 20 kg of CO2 from coal.

In Europe, almost all hydrogen comes from natural gas.

A first way to limit its carbon footprint consists in recovering part of the CO2 before it dissipates into the atmosphere: which is then “blue hydrogen”, limiting therefore climatic damage.

Under current conditions, gray hydrogen costs about €1.5/kg in Europe, slightly more than in the United States or China where gas and coal are cheap. Furthermore, storage and transport costs are limited by the proximity between production and consumption sites, most of the current installations being located in refineries or petrochemical estates.

Another way to produce hydrogen is through electrolysis ("green" hydrogen), which uses electrical energy to get the hydrogen present in the water.

Electrolysis then makes it possible to store excess electricity by transforming it into hydrogen, which becomes an integrator of renewable sources in the energy system.

How to make green hydrogen competitive

The cost of producing green hydrogen by electrolysis depends on three parameters: the price of the electricity used in the electrolyser, the cost and efficiency of this electrolyser, the transport and storage costs from the production site.

Currently, the cost of a kg of green hydrogen is within a range of the order of 3 to 6 €/kg, i.e. two to four times that of gray hydrogen. But it is luckily in a sharp decline thanks to the fall in the cost of green electricity and that of electrolysis.

All the worldwide hydrogen projects aim to accelerate the movement by increasing the scale of the production of electrolysers and investments in storage and distribution networks.

Aid for the use of green hydrogen in the form of a price supplement is more debatable from an economic point of view.

The production of green hydrogen from renewable biomass is another way that could prove the test of time but it is still in the experimental stage.

Finally, green hydrogen could decarbonise industrial processes in the future where substitutes for fossil fuels are difficult to develop.

The most important would be in the steel production where hydrogen could replace coal and provide zero carbon steel. The first industrial test to produce steel with hydrogen is being developed in northern Sweden, as part of the Hybrit project.

Europe facing the hydrogen revolution

Europe has put several tens of billions on the table to support investment programs.

Germany and France are planning to invest 9 and 7.2 billion respectively of public money by 2030.

They have significant advantages: they have global industrial gas industries (with companies like Linde and Air Liquide), they have major automotive and railway equipment manufacturers, excellent public research laboratories and a myriad of start-ups, many of which have emerged from these laboratories.

(Netherlands) Informatieplicht - EML: Information obligation of Energy saving

WHAT IS IT?

In the context of the Environmental Management Act , the Dutch government introduced in 2019 an obligation to provide energy information and energy saving measures from companies that consume more than 50,000 kWh or more than 25,000 m3 of gas per year (aside exceptions).

The obligation makes companies responsible for submitting a report to the government indicating energy-saving measures that have been taken and which measures will need to be taken.

This list of measures is established by the government and differs per sector, see list on here .

After submitting the report, a company must indicate every 4 years what actions have been taken to save energy.

Failure to comply with this policy will incur in a fine from the government.

The measures to be implemented must be submitted to the Netherlands Enterprise Agency in " eLoket " by July 2023, and all consumption data not later than December 2023.

UK SECR: How to comply

WHAT IS IT?

Since 2019, large UK companies have been required by the UK government to publicly report on their energy use and carbon emissions as a part of their Director's report.

From 2020 onwards, companies have been required to disclose their prior year's figures for comparison.

This requirement is impacting circa 12,000 businesses across the UK, most of which are reporting their emissions for the first time.

For some companies, SECR replaces the Carbon Reduction Commitment (CRC) Energy Efficiency Scheme that ended in 2019.

SECR also replaces and widens the Mandatory Greenhouse Gas Reporting (MGHG), which demands quoted companies to report only their annual GHG emissions.

WHAT IS THE BENEFIT?

The aim of the reporting requirement is to provide greater transparency to all stakeholders, but also to increase awareness inside organizations concerning energy costs, and to provide them with data about energy efficacy improving measures, therefore cutting their negative impacts.

DO I NEED TO COMPLY?

SECR applies to quoted companies, large unquoted companies and large LLPs.

A “large” unquoted company is defined by the Companies Act as having two or more of the following requirements:

employ 250 or more people
have an annual turnover of £36 million or more
have an annual balance sheet of £18 million or more

If your business fit the above criteria but the annual consumption is 40MWh or less during the reporting period, you are not required to disclose energy and carbon information, however, you are required to state why it is not being disclosed.

WHAT TO DISCLOSE?

Quoted companies :

Energy consumption and greenhouse gas (GHG) emissions for reporting period
Underlying global energy use
Previous year’s figures for energy use and GHG emissions
At least one intensity ratio
A "narrative description" that explains the energy efficiency measures taken
The methodology used for the calculation of the reported data

Unquoted companies :

As a generic rule, reporting companies are expected to publish their SECR disclosures as a part of their Director's report.

However, in the case where energy use and emissions are of strategic importance to the company, it is possible to make the disclosure in the Strategic report instead. If a company chooses to make the disclosure in its Strategic report, the decision will need to be clearly indicated and explained in the Director's report.

WHAT IS THE DEADLINE?

SECR is annual: disclosures cover the same reporting period as the financial year of your business, and if this is not the case, a separate explanation for the deviation is required.

HOW LONG DOES IT TAKE TO COMPLETE THE ASSESSMENT?

There is no right answer as this depends on each business structure, however planning in advance is key and we would highly recommend starting as soon as possible.

WHAT ARE THE PENALTIES FOR NON-COMPLIANCE?

The Conduct Committee of the Financial Reporting Council are in charge of enforcing SECR.

Late filing penalties are up to £7,500 depending on the type of company and how late the accounts are submitted.

WHAT IS IT?

The EU Energy Efficiency Directive (EED) is a European mandatory energy audit scheme that requires large enterprises to undertake a high-quality energy audit every four years and comply with the relative obligations in each country.

The main goal is to assist companies in identifying and implementing cost-effective energy savings and taking action in lowering carbon emissions.

It was introduced as the response to Article 8 of the EU Energy Efficiency Directive 2012/27/EU (EU EED), which has been transposed into national legislation in all EU Member States.

WHAT IS THE BENEFIT?

The stated purpose of this directive is to identify cost effective energy saving measures driving significant net cost savings.

DO I NEED TO COMPLY?

Your business needs to comply to EED if you meet either of the following criteria on the qualification date of 31st December 2022:

employ 250 or more people
have an annual turnover in excess of €50 million and an annual balance sheet total in excess of €43 million

Some member states will have additional local rules for compliance, so it is important to make sure that regulations are checked.

If your company operates in Europe we recommend a centralised pan-European EED route to achieve the most from compliance and to reduce costs.

If your company is fully covered by ISO 50001, there is no requirement to carry out an EED assessment, but a notification to the local regulator must be sent out.

ESOS (Energy Savings Opportunity Scheme): WHAT IS IT?

The Energy Savings Opportunity Scheme (ESOS) is a mandatory energy audit scheme in the UK for large organisations and it must be completed every four years.

The main goal is to assist companies in identifying and implement cost-effective energy savings and take action in lowering carbon emissions across the UK.

It was introduced as the UK government’s response to Article 8 of the EU Energy Efficiency Directive ( EED ).

WHAT IS THE BENEFIT?

The scheme is designed in such a way that, if your business complies with the energy-saving advice provided along with the assessment, the cost savings on energy bills should surpass the assessment fee. In fact, according to the government, participants might save 13.5 times the assessment fee.

DO I NEED TO COMPLY?

Your business needs to comply to ESOS if you meet either of the following criteria on the qualification date of 31st December 2022:

employ 250 or more people
have an annual turnover in excess of £44 million and an annual balance sheet total in excess of £38 million

This includes any overseas company with a UK registered establishment which has 250 or more UK employees (paying income tax in the UK).

The scheme largely excludes the public sector.

If your company operates in Europe we recommend a centralised pan-European EED route to achieve the most from compliance and to reduce costs.

If your company is fully covered by ISO 50001, there is no requirement to carry out an ESOS assessment, but a notification to the regulator must be sent out.

Notification of compliance to the Environment Agency must be done by 5 December 2023.

The Environment Agency manages the scheme for the UK and regulates it in England.

For UK offshore, it is regulated by the Secretary of State for Business, Energy and Industrial Strategy.

WHY PROCURE FOR RENEWABLE ENERGY?

Renewable energy procurement allows a business to claim to be using zero-carbon electricity, and thereby reduce the portion of their carbon footprint associated with purchased electricity.

HOW IS RENEWABLE ENERGY CERTIFIED?

Renewable energy certificates (RECs) are used in USA. The main equivalent in Europe are called Guarantee of Origin (GO) or Renewable Guarantee of Origin (REGO) in UK.

USA => RECs

EU => GO

UK => REGO

These are credits that represent the environmental and other non-power attributes of renewable electricity generation and are a component of all renewable electricity products (one REC/GO/REGO for every 1 MWh or 1,000 kWh).

RECs/GOs/REGOs are measured in single megawatt-hour increments and are created at the point of electric generation.

Buyers can select RECs/GOs/REGOs based on the generation resource (e.g., wind, solar, geothermal, etc), when the generation occurred, and the location of the energy source.

WHAT ABOUT CARBON OFFSET?

It is important to note that RECs/GOs/REGOs cannot be purchased as a method of carbon offset , but only carry the environmental attributes of renewable energy.

The two mechanisms (RECs/GOs/REGOs and Carbon offset) are different and serve different purposes:

Carbon offsets allow companies to reduce their liability for greenhouse gas emissions, with each carbon offset financing a one-ton reduction in carbon dioxide (CO2e) emissions through a variety of projects.

RECs/GOs/REGOs account only for renewable energy generation— most often electricity—and thus represent a direct impact on the energy system (in effect reducing emissions associated with power consumption).

I'D LIKE TO KNOW MORE ABOUT THE USA.

In the US, RECs on the voluntary market are generally sold unbundled, or de-coupled from the physical electricity delivered to the grid.

Companies can also procure bundled RECs that are tied to their local grid or participate in utility green programs that fund renewable energy development and REC purchasing by the utility.

Geography and type of states often plays a role in REC pricing.

I'D LIKE TO KNOW MORE ABOUT THE UK AND EUROPE.

In the EU/UK GOs/REGOs and RECs fulfil the same function and are of the same quality.

Where they differ is that GOs are issued by E.U. governments and are recognized in all E.U. Member States (where available) under the “RES Directive” (2001/77/EC and its successor, 2009/28/ EC), while the REGOs are issued in the UK by Ofgem (The Office of Gas and Electricity Markets).

On the contrary, RECs are issued by energy companies and may not be accepted by all countries.

GOs/REGOs/RECs enable producers of electricity from renewable energy sources or from high efficiency cogeneration to demonstrate that the electricity sold is produced from approved sources or technologies.

Each electronic GO/REGO/REC should detail the following in MWh:

the source of the electricity
the dates when it was produced
the identity, location, type, and capacity of the production facility
whether the GO relates to electricity, heating, or cooling
whether and to what extent the installation has benefited from outside support
the date when the installation became operational
the date and country of issue
unique identification number

WHAT ARE FEED-IN TARIFFS (FITs)?

A feed-in tariff is a policy mechanism designed to accelerate investment in renewable energy technologies.

FITs typically offer renewable energy producers a guaranteed access to the grid and long-term contracts based on the cost of generation of each technology.

The costs incurred are included in the electricity price and thus, passed on to the final consumers via their electricity bills.

For instance, producers using wind power receive a lower kWh price compared to producers using solar PV, who receive a higher price, reflecting higher costs. In addition, FITs often include “tariff degression”, a mechanism according to which the price (or tariff) ratchets down over time to track and encourage technological cost reductions.

ON PROCURING RENEWABLE ELECTRICITY.

The quality of the renewable electricity procurement is to be defined by the three main principles:

1. Energy Attributes

Exclusive ownership and claims of the energy attributes of the renewable electricity generated, either through onsite self-generation and consumption or via Renewable Energy Guarantees of Origins certificates (REGOs/GOs).

Each REGO/GO certificate represents the 'energy attribute', i.e., the zero GHG emissions, associated with 1MWh of renewable energy generated.

REGO/GO certificates must be retired on the Renewables and CHP national Register to prevent double counting of the energy attribute elsewhere.

2. Renewable Sourced

Renewable non-fossil fuel energy sources, that is, wind, solar, aerothermal, geothermal, hydrothermal and ocean energy, hydropower, biomass, landfill gas, sewage treatment plant gas and biogases.

3. Additionality

The principle of additionality applies when an organisation/consumer installs, self-generates and consumes renewable energy from their own facilities, or closes an electricity purchasing contract that contributes to the construction of new renewable energy facilities.

Projects that comply with the principle of additionality result in real and verifiable emission reduction or emission avoidance for the organisation / consumer, as their direct effect is to increase renewable energy generation.

Is nuclear renewable? How many plants in UK and EU?

SUMMARY.

We are often asked if nuclear energy is renewable and how much nuclear power there is in Europe and if this can help reduce dependency from Russian gas imports.

This article is aiming at giving a quick overview as of today.

HOW ARE NUCLEAR PLANTS DISTRIBUTED IN THE EUROPEAN CONTINENT?

The United Kingdom is the 2nd country in the European continent with the largest number of nuclear reactors in service (11), after France (56) and ahead of Spain and Belgium (5).

As of December 2021, the 126 nuclear reactors in the European Union were distributed among 13 countries. However, there are significant power production disparities between these countries:

France has the largest number of nuclear plants and the biggest production capacity in Europe (approximately 61.4 GW) and the 2nd in the world after the United States (with 56 nuclear reactors in service).

In addition, at least 4 more nuclear reactors are currently under construction in the European Union to fight the energy dependency from Russia.

IS NUCLEAR ENERGY RENEWABLE?

Nuclear energy is a sustainable energy source but it is not currently renewable.

This is mainly because of the mining of Uranium, the fuel that is required to have nuclear energy.

It is often referred to as ‘clean’ energy because it doesn’t produce carbon dioxide or other greenhouse gases when electricity is generated but there are several advantages and disadvantages:

Pros of nuclear energy

High capacity factor, making it one of the most reliable energy sources in the world.
Once built, plants are not so expensive to run.
Not so much land is required to build a plant, unlike wind and solar farms.
Very low carbon emissions.

Cons of nuclear energy

Radioactive waste (radioactivity waste is predicted to last circa 10,000 years and risks are extremely low).
Power plants take a long time to be built.
Power plants are very expensive to build.
The mining of Uranium-235, which it its main fuel source and which has a limited supply on Earth.

IS NUCLEAR ENERGY THE FUTURE?

The production of electricity from nuclear energy already accounts for a significant portion of global power production, and it is probably going to do so in the future.

Thanks to improved safety procedures and technology, nuclear energy production risks are far less dangerous than they were decades ago. However, since ageing power plants must be dismantled, we must take into account nuclear power's contribution to the long-term development of a clean power system.

Additionally, compared to energy sources that rely on fossil fuels, nuclear energy is surprisingly inexpensive to produce, incredibly dependable and secure, and also far cleaner.

Of course, there are still dangers and uncertainties associated with nuclear power that some energy experts find unsettling.

Nuclear energy also uses a limited resource on Earth; therefore, the sustainability discussion will undoubtedly continue.

Nuclear power plants are far more effective and clean when it comes to producing energy than gas and coal alternatives.

Many people claim that, in addition to solar, wind, hydro and geothermal energy, we should also invest in nuclear power.

Whichever line of thought you agree on, one thing is clear: our energy system must be improved and restructured immediately.

It's unclear if nuclear power should be used to improve our system, but we do know for certain that renewable energy sources like solar, wind, and hydro will continue to give their contribution.

Energy prices: what changed since 2018?

SUMMARY.

In the context of soaring energy prices, which started before the war in Ukraine, we are sharing some of the major developments since 2018 in the energy markets and in the European carbon market with insights from economists.

OIL.

As a reminder, the average price of a barrel of Brent was $71 in 2018 (while it had peaked at more than $100 on an annual average in 2011, 2012 and 2013). The Covid-19 health crisis paralysed the world economy (in particular the transport sector), and caused a collapse in oil prices: the price of a barrel of Brent fell to $18, compared to around $65 at the end of 2019.

With the post-Covid economic recovery, the price of Brent rose to nearly $105/barrel over the first 9 months of 2022:

In 2021, oil prices rose to more than $70/bbl on average driven by the economic recovery and OPEC+'s strict supply control policy.

Prices increased at the end of 2021 as a result of the decline in OECD stocks, in particular to compensate for the insufficient supply from OPEC+.

In 2022, the war in Ukraine was certainly a major reason for significant uncertainty about supplies at the start of the year and the lack of investment in exploration-production all over the world has accentuated the phenomenon with insufficient supply and stronger influence of the 23 OPEC+ producers (Saudi Arabia and Russia in the lead) on prices.

In recent news, OPEC+ announced on October the 5th a reduction of 2 million barrels per day (Mb/d) in the production in November 2022 compared to the August levels in 2022. A problem for the United States, which announced "consequences" for this decision favourable to Russia.

According to Reuters, the price of a barrel of Brent could navigate between $75 and $120 in 2023 with two forces at play: the restrictive supply policy led by OPEC+ and a possible drop in global oil demand linked to a decline in global economic growth.

NATURAL GAS.

Gas prices in the European market (TTF) are approximately 5 to 10 times higher than the American market. A sharp increase in deliveries of American LNG to Europe could impact economic activity in the United States but also it will retain a margin of competitiveness compared to Europe.

In the European market ("TTF" market place in the Netherlands), it should first be noted that the rise in the price of gas started before the war in Ukraine and it was driven in the 2nd half of 2021 by the economic recovery, particularly in China with already constraints on supply. At the end of 2021, the level of inventories filling was therefore relatively low in Europe.

The start of the war in Ukraine led to many uncertainties, but the gradual stop of Russian imports increased prices which soared in August 2022, with the collapse of Russian deliveries via Nord Stream 1 which were only partially offset by LNG deliveries to Europe.

The price of gas fell sharply in the European market in October 2022 with European announcements on increased supply demand, which was reassuring for the markets. However, prices still remain very volatile, in particular due to availability of American LNG to Europe.

Strong price variations are possible over the coming months; the current trends show that the market is currently anticipating tensions throughout 2023.

COAL.

The price of coal – the world's leading source of electricity, has not soared like gas.

This can be explained by the fact that the coal market is a fairly competitive market with many suppliers and growth prospects are less optimistic for China, which is by far the world's largest importer of coal (China accounted for nearly 52% of global coal consumption in 2021).

Added to this there has been a sharp drop in the cost of maritime freight.

ELECTRICITY.

Electricity prices in Europe largely follow the evolution of gas prices.

This strong correlation is due to the logic used is setting prices based on the last plant generating gas - generally a gas plant during periods of high consumption.

Price volatility is also driven by the uncertain availability of renewable or nuclear production.

URANIUM.

The cost of uranium is quite modest in the production cost of nuclear power.

The resumption of nuclear power plant construction projects (56 reactors under construction worldwide, including 18 in China and 8 in India is the main cause of the sharp increase in the price of uranium - a price that was very low until 2020.

CO2 IN THE EUROPEAN CARBON MARKET.

To understand the surge in price of carbon per tonne of CO2 in 2021, it must first be remembered that this market entered in 2021 with a much more restrictive distribution of CO2 emission certificates. The stability reserve system (implemented in 2019) also makes it possible to temporarily or permanently withdraw certificates to avoid an oversupply on this market.

The rise in the price of gas has also encouraged the use of coal-fired power stations which emit a lot of CO2 and therefore this has led to an increase in the request for more CO2 certificates. The economic recovery and the lack of nuclear production or the availability of renewables have reinforced this increase in the price for a tonne of CO2 .

As an indication, a price per ton of CO2 of €70 increases the cost of electricity production by €28/MWh for gas and by €68/MWh for coal.

ÉCO ÉNERGIE TERTIAIRE (Tertiary Decree)

WHAT IS IT?

The Tertiary Decree is a French regulatory obligation which aims to engage all tertiary players towards energy sobriety.

Resulting from the Décret tertiaire (Dispositif d’Economie d’Energie: DEET), this obligation requires the gradual reduction of energy consumption in buildings for tertiary use to fight against climate change and improve the operation and comfort of these buildings.

The official article is R.174-22 du CCH .

To achieve this dual objective, the actions implemented go beyond the energy renovation of buildings, and concern the quality and operation of equipment as well as the behaviour of users.

WHO IS CONCERNED BY THE TERTIARY DECREE?

All tertiary buildings with a surface area of more than 1,000 m² are concerned.

This includes shopping centres, buildings, parts of buildings or set of buildings, with an area (or a combination of areas) allocated to tertiary use equal to or greater than 1,000 m2.

This includes both landlords and tenants.

WHAT MINIMUM REDUCTIONS IN FINAL ENERGY CONSUMPTION ARE EXPECTED?

2030: -40%
2040: -50%
2050: -60%

It is necessary to achieve either a relative saving (-40%, -50%, -60%) compared to a reference year chosen between 2010 and 2019, or an absolute value compared to a value calculated according to use and the location of the premises.

These objectives may be modified in the event of:

Technical, architectural or heritage constraints, change in the activity carried out in the building(s), evolution of the volume of activity, manifestly disproportionate costs of the actions to be undertaken in relation to the expected benefits on energy consumption.

HOW TO REPORT THE ENERGY CONSUMPTION?

Owners, lessors or occupants have the obligation to declare the consumption of their tertiary premises on the platform OPERAT.

This platform makes it possible to obtain an annual certificate when the consumption is submitted.

WHAT ARE THE PENALTIES AND FINES?

In the event of non-transmission of information on the OPERAT platform or non-submission of an action program when the objectives are not achieved, a sanction mechanism applies (after formal notice).

The name of the offender may be posted on a public website.

It may be accompanied by an administrative fine of up to 7,500 euros for businesses.

The article concerned for the penalties is l’article R. 185-2 du CCH .

WHAT ARE THE DEADLINES?

The energy consumptions must be communicated annually on the OPERAT platform with the consumption information for the two previous years and the chosen reference year.

Carbon and GHG: Understanding Key Terms

A USEFUL KEY TERMS GUIDE.

Communication around the impacts of climate change is much clearer than it was a decade ago.

Here is a quick list of some basic concepts in sustainability to understand GHG accounting and other intricacies of carbon markets and net zero economies.

GHG Protocol.

The standard global accounting method for measuring an entity's direct, downstream, and upstream GHG emissions. This protocol defines methodologies for calculating and defining the scope of emissions, as well as informing the standard setting criteria of many other reporting frameworks such as CDP, GRI, TCFD, SASB, and SBTi.

Greenhouse Gasses (GHG) and Carbon.

Greenhouse gases are gases contributing to the greenhouse effect (atmosphere warming) by absorbing infrared radiation. Carbon is the most common greenhouse gas emitted by human activities and is therefore used in shorthand to refer to a number of other greenhouse gases.

CO2e.

Carbon (CO2) is typically used as the equivalent metric for quantifying other gasses, known as CO2 equivalents or CO2e. A quantity of GHG can be expressed as CO2e by multiplying the amount of GHG by its Global Warming Potential.

Global Warming Potentials.

The Global Warming Potential (GWP) was developed to allow comparisons of the global warming impacts of different gasses. Specifically, it is a measure of how much energy the emissions of 1 ton of a gas will absorb over a given period of time, relative to the emissions of 1 ton of carbon dioxide (CO2).

Footprint-based approaches.

These include pure accounting methods for current emissions and do not necessarily regard emissions reduction strategies. Approaches include Life Cycle Assessment methods and GHG/Carbon Accounting . Carbon accounting is the process of quantifying the amount of greenhouse gases produced directly and indirectly from a business or organisation’s activities within a set of boundaries.

Sustainability reports.

Reports that provide emissions information developed and released by a company.

Carbon offsets.

Allow businesses, who cannot reasonably reduce or halt their own emissions to balance out the total emitted greenhouse gases in the atmosphere to zero by purchasing the active emissions reductions of another party elsewhere. Offsets are calculated relative to a baseline that represents a hypothetical scenario for what emissions would have been in the absence of the project.

Carbon sink.

A carbon sink is anything, natural or otherwise, that accumulates and stores some carbon-containing chemical compound for an indefinite period and thereby removes carbon dioxide from the atmosphere. Corporations may acquire land rights for designated areas of carbon sinks such as forests or seagrass meadows, or contribute to restoring these natural areas in order to qualify the area as an offset.

Scope 1, 2, and 3 Emissions.

Emissions are classified into scopes for differentiating between direct and indirect emissions of a business and for more accurate measurement and reporting overall.

CONCLUSIONS

Carbon Accounting requires access to accurate real time and historic energy data that can be traced back to the source, easily audited for compliance and rooted in international standards for GHG emissions factors.

Spreadsheets and excel are most likely not enough when trying to run data accurate calculations across multiple business operations and with differing sources of emissions.

What is a EU CROSS-BORDER VPPA?

WHAT IS IT.

A cross-border VPPA is a “financial swap” for the underlying value of energy, not the energy itself.

The electricity generated under a VPPA contract isn’t physically delivered to the buyer. Instead, it’s sold into the wholesale electricity market.

Under this contract, the generated energy is delivered to the grid, the corresponding RECs/GOs are delivered to the buyer, and since it can be traded in Europe, which is a common energy market, energy can be produced in one EU country and delivered to another.

The concept of cross border VPPA is still young in Europe and therefore it is still quite new to many international vendors.

CLAIMED BENEFITS.

Cross-border VPPAs enable companies to add new amounts of renewable energy to a specific grid and therefore the possibility to contribute in reducing emissions in those more carbon-intensive electricity markets.

Green targets: VPPAs support companies in reaching their sustainability goals.

Geographical flexibility: VPPAs vendors claim that companies with facilities that are geographically widespread – such as retailers with thousands of locations – can meet the energy needs of those locations with a single VPPA contract.

Favourable terms: cross-border VPPAs offer the ability to source renewable electricity in locations that have the most beneficial price terms.

Cross-border VPPAs allow companies to aggregate electricity consumptions from different markets under one VPPA contract.

Tax incentives in certain markets.

Increase in image and reputation of a company.

CLAIMED RISKS AND CRITICISM.

Sourcing and contracting a pan-European VPPA can be very complex as it requires assessment of the risks and due diligence in each country involved, given the price and legal differences between European countries involved.

Cross border VPPAs require sufficient flexible generation sources to match a demand in the desired cross border country.

Price risks: cross-border price risk is inevitable when the buyer and seller are in different market zones. The options for hedging this risk are limited and may have only short-term impact.

Electricity prices may change in the market where the renewable generator is located. For example, changes in a country’s energy mix could have a negative effect to the cross-border pricing, particularly when fossil fuel generation is reduced and/or renewable generation is increased, which is where all EU countries are moving towards to anyway.

Change in law risks: regulations may change in each EU market over the course of the cross-border VPPA contract, therefore having a financial impact.

Accounting, legal and taxation implications must be carefully reviewed.

Potential risks and regulatory barriers across the EU member states:

Some countries may impose a reduction in their renewable energy intake due to grid capacity limits
Possible limitations in the current GOs-systems: there are some countries that may not allow cross border transfers or would only allow local suppliers to trade the GOs.
Different tax regimes and legal systems can be an issue when engaging in a cross-border VPPA

Retail businesses which usually lease facilities, need agility and scalability in their locations and therefore they are usually a better fit for GOs or RECs rather than PPAs.

Greenwashing: cross-border GOs have been criticised as a tool for greenwashing as it allows companies to call themselves “green” taking advantage of lower prices in a particular EU country, despite using non-renewable energy in their supplier’s production mix.

Scepticism: multinational companies, such as Facebook, expressed scepticism to cross-border VPPAs in 2018 in the press “as something that they are not currently looking at” - Colin Spain, Facebook’s head of EU renewables.

Sustainability criticism: Some experts argue that cross-border VPPAs may support the building of renewable generators only in those countries with good wind or solar conditions or where the price is much cheaper than others.

CONCLUSIONS.

A contracted cross-border VPPA must be right for a company to make sense financially.

When communicating about your cross-border VPPA, your company should be transparent about the details of the project taken, location, markets and sources involved and should also clearly state the drivers for choosing this type of contract.

It is therefore recommended having professional advice to help you understand whether this is the right choice for your company.

What are green electricity offers?

After COP26 held in Glasgow in October 2021 and in the context of the global climate crisis, green energy occupies a significant place in the global political debate. More and more businesses want have energy contracts which display their green commitment.

To meet this demand, energy suppliers have developed new offers that are supposed to increase green electricity. This involves supplying electricity from renewable sources (wind, solar, hydro, etc.).

But what do such offers really cover? Does subscribing to these contracts really lead to a green commitment?

Green electricity: what is it?

Green electricity, invisible from the grid.

First of all, you should know that you do not have the possibility of controlling the origin of the electricity which reaches your meter from the public distribution network. In fact, it is not possible to make a distinction between electricity from renewable sources to those from traditional sources (nuclear power stations for example).

If you absolutely want to consume electricity that comes from renewable energy production facilities, you will have to consider becoming a producer yourself by installing photovoltaic panels on your land, for example, to be self-sufficient. But we will only talk here about green electricity supplied by the public distribution network and not self-production.

Connecting to the electricity network therefore means accepting that you don't know where the electricity you actually use comes from, however purchasing green electricity contracts should encourage the increase of renewable energy production facilities .

The complexity of the green electricity market.

As mentioned before, by subscribing to a green electricity offer, you will not necessarily consume electricity produced from the wind or solar panels, however your supplier commit to place into the network a quantity of green electricity equivalent to the one you actually consume. It is therefore a system that works by equivalence.

In order to be able to justify this, suppliers purchase Guarantees of Origin (GO) from renewable energy producers. These green energy producers can, in proportion to their production, sell certificates to suppliers which will guarantee the placement into the network of a certain quantity of electricity.

This mechanism of European certification by the Guarantees of Origin has been the subject of numerous criticisms.

Its critics think that it would allow certain suppliers to "greenwash" by marketing green offers that are not really green. These suppliers would continue to generate energy from polluting facilities such as gas or coal-fired power stations, even if they buy guarantees of origin from green producers to be able to market their so-called green offers.

This system does not strongly encourage the production of new renewable energy, and the cost of purchasing the guarantees are obviously passed on to the end customer, therefore increasing the cost of the electricity invoice.

Check the terms!

If you are keen to choose a green electricity offer, in order to show your commitment to the green energy transition, you must take a few precautions before signing your contract.

You should check under what conditions your supplier participates in the renewable energy market. To do this, consult their terms and conditions and look at their certificates.

You can also look at the place of renewable energy productions that your supplier purchases from.

Finally, remember to carefully read the tariff information sheet linked to the contract, before agreeing what you pay for green electricity.

How to purchase energy now?

Times are tough for businesses across the globe, with many still reeling from recent energy cost increases.

Concerns continue to rise with the prospect of a further decline of Russian gas flowing into Europe.

Natural gas has now soared 700% driven by the war in Ukraine with prices in Europe and Asia which rose more than 60% in the weeks since Freeport LNG Texas terminal was forced to temporarily shut down last month.

Nowdays energy prices fluctuate enormously. In the past, prices for gas and electricity were a relatively constant factor but today, the price charts are more like a roller coaster, which does not make it any easier for those who are responsible for purchasing energy for their business.

The energy market is so unpredictable: prices for gas and electricity have a strong correlation. They are linked to each other because much of our electricity is produced with gas-fired power stations. The winter of 2021 was relatively cold, which means that many gas reserves have been used up. Furthermore, in 2021 there was little wind to generate green electricity.

In addition, gas prices in Asia have risen, pushing up prices worldwide. And now there is also the war in Ukraine, which means that alternatives have to be found to replace Russian gas.

Hedging price risks

As we are independent consultants, we want to offer our customers clarity about all of the prices involved in purchasing energy. But how do you do that if prices fluctuate so quickly?

We do it by hedging the risks (whether it is a Fixed or a Flexible energy product) and advising our customers on the best time to purchase or running one or more tenders with different suppliers to increase competition.

The increase in green energy

All energy prices are linked. This also explains why even the price of green energy simply moves with the market. It doesn't matter where the power comes from, what matters is how much is available. For example, on April 23rd of this year in the Netherlands the price of electricity suddenly became negative. The electricity generated by wind and solar exceeded the demand. Due to the increasing supply of green energy, we see more often that electricity is cheaper during traditional peak hours than during off-peak hours. This shows how complicated it has become to buy energy.

Will the increasing supply of green energy lower the prices of all energy? The price is more likely to rise, because renewable energy increases uncertainty.

If an energy supplier needs to have a contract with a vendor of solar energy production and they promise a fixed price, they have to invest money as they don't know when the sun will shine next year for example, however there is good news in the longer term. as technology is improving day by day with better energy storages and batteries.
